Terms of Service

Welcome to Jauda. By using the Jauda mobile application and related services, you agree to these Terms of Service. If you do not agree, do not use Jauda.

1. Beta Period — Free Access

Jauda is currently in beta and provided free of charge. There is no paywall, no subscription, and no billing of any kind. When Jauda launches commercially, you will be notified before any pricing takes effect. You are under no obligation to continue using Jauda at that point.

2. Permitted Use

Jauda is provided for personal, non-commercial fitness logging, heart rate variability analysis, and structured workout guidance. You agree not to: reverse engineer, resell, or redistribute the service (except as permitted by applicable law, including your statutory right to decompile the software for interoperability purposes under the EU Software Directive 2009/24/EC); use the API in a manner that exceeds reasonable rate limits; or upload malicious or illegal content.

3. Health & Safety Disclaimer

Jauda is a fitness analytics tool — not a medical device. Heart rate, HRV, VO2max estimates, and training load metrics (CTL, ATL, TSB) are algorithmic estimates and must not be used to diagnose, treat, or prevent any medical condition. Consult a physician before beginning any exercise program.

Cycling carries inherent risks including but not limited to: traffic accidents, falls, equipment failure, adverse weather, and cardiovascular events. You are responsible for your own safety. Always ride within your limits, follow traffic laws, and use appropriate safety equipment. Jauda is a data-logging and analytics tool — it does not provide real-time hazard detection, collision avoidance, or safety alerts.

To the fullest extent permitted by applicable law, Jauda disclaims liability for incidents or injuries arising from reliance on sensor data, algorithmic estimates, or GPS information provided by the app.

4. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Jauda does not guarantee the accuracy, completeness, or reliability of: heart rate sensor readings, HRV (RMSSD, DFA-a1) calculations, VO2max estimates, CTL/ATL/TSB training metrics, GPS positioning, speed, or distance measurements. Sensor dropout, GPS drift, and algorithmic variance are inherent limitations of consumer hardware. Always rely on professional medical equipment and advice for cardiovascular health monitoring.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Jauda and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, service interruption, or device damage arising from your use of Jauda. During beta, Jauda is provided free of charge. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (which is zero during the beta period).

Nothing in this section excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) willful misconduct or gross negligence; or (d) any other liability that cannot be excluded or limited by applicable law.

6. Your Data & Content

You retain full ownership of all workout data, physiological records, and GPS tracks you record or upload to Jauda. We do not sell, license, or monetize your data. By using the service, you grant us a limited license to process your data solely to provide the features described in our Privacy Policy. See our Privacy Policy for details on data handling, third-party processors, and your GDPR/CCPA rights.

7. Intellectual Property

Jauda, its name, logo, design, algorithms, and source code are the intellectual property of Jauda. These Terms grant you a non-exclusive, non-transferable, revocable license to use the Jauda app for personal purposes. You may not copy, modify, distribute, or create derivative works of the Jauda software.

8. Termination

You may stop using Jauda and delete your account at any time via Settings → "Delete Account". We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or abuse the service. For curable violations, we will provide reasonable notice and an opportunity to remedy the issue before terminating your access. During beta, Jauda is free, so no refunds apply. Upon termination, your right to use Jauda ceases immediately. Your data will be handled according to our Privacy Policy's data retention and deletion provisions.

9. Governing Law

These Terms are governed by the laws of Latvia and the European Union. Any disputes arising from these Terms shall be resolved in the courts of Latvia. Nothing in these Terms limits your rights under mandatory consumer protection laws in your country of residence.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app. For material changes that affect your rights or obligations, we will request your explicit agreement before the changes take effect. For non-material or administrative changes, continued use after the effective date constitutes acceptance.
